Success - Planning appeal won for a two storey side extension to house in East Sheen, LB Richmond-upon-Thames

I was instructed to write the appeal statement for a two storey side extension to a house on Sheen Common following a refused planning application.   I undertook a site visit, wrote the statement, submitted and gained planning permission for the owners.

Site visit, advice and planning statement drafted for a basement extension, front lightwell, single storey rear extension and alteration to the first floor terrace to a large house in Richmond. I have advised the architects dealing with the project and sought amendments prior to the submission to ensure the application is approved within 8 weeks. I have submitted the application for the owners and await the decision.

Planning appeal submitted for dormer extension - Richmond upon Thames
April 2014
Site visit and appeal statement for a client who received a refusal decision notice for a dormer roof extension to their property in Twickenham. The appeal has now been submitted and the decision is pending.

Objection letter written against planning application - Teddington
April 2014
Instructed by an owner of a property in Teddington concerned about a planning application submitted by her neighbour.  Undertook a site visit and wrote an objection letter. Liaised with the planning officer and also contacted the enforcement team about unauthorised works to the site. Decision pending.

Planning advice for a public inquiry enforcement appeal for Basingstoke and Deane Council

The Development Control Manager at Basingstoke and Deane Council instructed me to appear as their planning expert at a public inquiry enforcement appeal. I undertook the site visit and conference with the barrister. On advice from the barrister the Council decided not to proceed with the appeal.

Success - Planning permission granted for 2 storey rear extension to two properties - Twickenham - LB Richmond

The owner contacted me following refusal of two planning applications. I advised what I considered could be approved and re-submitted a joint planning application for a two storey rear extension to two adjoining properties. I wrote a statement to support the application, completed the application form and submitted the application on behalf of the owners. I had to negotiate hard with the planners and sought amendments for the application after the planners recommended refusal. One month after the decision was meant to be given, we won planning permission.
 
Success - Appeal won against a refused Certificate of Lawfulness in RB Kensington & Chelsea
February 2014
The Royal Borough of Kensington and Chelsea refused a Certificate of Lawfulness to establish the lawful use of a property as a dwellinghouse. The Council are of the opinion that the property at ground floor was a Clinic (use class D1) but the property was sold to the current owner as a dwellinghouse. I have written the appeal statement and submitted the appeal for the owners. At the Hearing in December, I successfully argued and proved that the property had been in use mainly as a dwellinghouse for more than 4 years and the Inspector granted the Lawful Development Certificate so the owner's property is now lawful.
 
Success - Appeal won for a dormer in AONB, Beenham, West Berks Council

West Berks refused planning permission for the erection of a dormer extension to a bungalow in an area where there were other large dormers. I wrote the planning statement and was successful in gaining planning permission for the owners of the property.

I advised a developer whether it was worth buying a bungalow in the Green Belt for re-development, assessing the Council's policies and recent planning decisions on similar sites.

I was asked to look at a site for sale in the Green Belt in Winkfield, near Bracknell. I advised on the restrictions of redeveloping in the Green Belt and given the modest sized dwellinghouse on the site it would be unlikely that permission would be granted for a much larger house, such as those nearby which are within the Green Belt settlement village.

I was approached by the owner of this property when he had received a letter from the Council's enforcement officer stating that the dormer which had been constructed required planning permission. I undertook a site visit and advised that there would be a good chance of gaining permission. I wrote the supporting statement and submitting the application for the owner of the property. Planning permission granted but the case officer had indicated he would refuse the application but I convinced the case officer the applciation should be approved.
 
Appeal against refusal by Hounslow for the erection of a new house
October 2013
I drafted the appeal statement and submitted the appeal against Hounslow's decision to refuse an application for a new house to the side of an existing dwelling. 
Appeal dismissed on grounds that the design of the dwelling was out of keeping with the character of the streetscene.

I have written the covering letter and submitted the application to the Royal Borough of Windsor and Maidenhead for the change of use of an office into residential.  The information demonstrated that there were no issues relating to flooding, contamination or transport/highways issues.  Application approved.

Planning advice prior to purchasing a new house in Twickenham

I provided a comprehensive analysis of how a dwelling could be extended for a house in St Margarets, Twickenham to give the purchaser the confidence that they could extend the house in the way they envisaged. I provided further advice in a follow-up telephone conversation.
 
Planning advice for the development of land in Chertsey, Surrey Heath Council

I analysed the planning constraints, the local policies and site circumstances of a site in Chertsey and drafted a report on the likelihood of developing the site for the erection of a dwellinghouse.

A resident of Barnes was concerned about the plans submitted by his neighbour for a large 2 storey side extension. I advised them of all the planning policy and guidance to aid them in a letter of objection.

I collated all the information, reports, plans and materials necessary to discharge 6 conditions for a new build house in Feltham. Details included samples of materials, hard and soft landscaping, acoustic insulation, sustainable drainage system, renewable energy details and Sustainable design and construction details. All conditions approved within 8 weeks.

Objection letter for change of use of house to care home in Ealing
May 2013
I wrote an objection letter for a resident's association who were concerned at the change of use of a dwellinghouse into a care home for young offenders in Ealing.
The application has since been withdrawn.
 
Expert Witness for Basingstoke and Deane Council at 8 day Public Inquiry
May 2013
I was the expert witness on planning matters in respect of a Public Inquiry for a scheme comprising 450 houses, school, community centre and open space. I represented Basingstoke and Deane against David Wilson Homes for the development of a greenfield site in the countryside, drafted the proof of evidence, Statement of Common Ground, a rebuttal proof and liaised with the team over the 5 month period leading up to the Inquiry.
 
Decision given by the Secretary of State to give planning permission on the basis that the Council did not have a 5 year housing supply.

Letter of objection against a house extension

I wrote a letter of objection for a couple who were concerned about the impact of a large extension to their neighbour's property. I advised about requesting that the application should be determined by the Planning Committee and further advised on the speech to be made to the Committee. Application refused contrary to planning officer's recommendation.

Pre-application advice for house on plot within Area of Outstanding Natural Beauty - West Berkshire

Submitted a planning statement to support a pre-application submission for the development of a small plot of land within the heart of an existing village within an AONB within West Berkshire Council.  The response was not favourable to developing anything on the land. Whilst disappointing, the client wanted to test whether any development would be feasible.

Advised a landowner of what development opportunities there were following refusal of planning permission by Hounslow Council. A two storey side extension was applied for to extend a property but I advised that a single storey extension which could be converted into a small separate unit could be achieved on site. Success - Appeal for demolition of garages and erection of 6 houses and an office - Barnes

Represented LB Richmond-upon-Thames at a hearing for the erection of 6 houses and an office with parking on a backland site in Barnes. Appeal dismissed for unneighbourly development, poor design due to cramped location. Other issues included financial contributions towards affordable housing, impact on neighbouring listed building, poor provision of amenity space, poor parking provision and impact on trees.
